1. The copyright of all the images on this website remains with R. Lewis Hooten, the photographer. The free images on this website may be used without payment providing the conditions of use are met. A non-exclusive license is required to use any of the other images, and this right of use is what you purchase when you buy a license. 2. What is a non-exclusive license? All R. Lewis Hooten material is under copyright and must be licensed. A license allows you use of an image in certain ways once an appropriate fee has been established. The license to use an image will appear on your invoice and will present exactly how the image can be used. When you buy an image license on this site you will receive a license that gives you permission to use that image. 3. The following limitations apply:
The license is non-exclusive (anyone may buy a license at anytime for the same image) and non-transferable.
The license has a duration of one year.
The image may only be used on the front or back cover of a printed publication with prior consent.
The images can be cropped and effects used (tints, sepia, borders, etc.), but you cannot add to or remove parts of the image.
4. The basic online license fee is currently $75.00 and includes Email delivery. The license grants the purchaser permission to use the image on a specific website or document for a period of one year. 5. Discounts are available if you require a reasonable number of images (25 or more in a single order). We will then supply the images on a windows compatible CD free of charge, and are willing to negotiate special rates. 6. We can mail your requested images on a windows compatible CD for an additional charge of $25. 7. There are a few free images on this site. Only the free images so labeled can be published without a formal license agreement, and then only if the terms and conditions have been met. Even if we have supplied an image by mail or email, it MUST NOT be published until you have received your license and paid the fee. If you publish an image prior to paying the fee, you will be charged for unauthorized reproduction as defined in the Terms and Conditions. 8. What is a release? A release is a documented agreement on which an individual or property owner gives permission to the photographer for an image of themselves or their property to be reproduced commercially. 9. Editorial use means that images are used to support the content of a magazine or news article or website article. Commercial use is when an image is used to promote or sell goods or services. Commercial photos where an individual or property can be identified will require a release. Usually our images do not require a release but it is the client’s responsibility to check if one is required. 10. The basic online license fee is fixed and non-negotiable. The fee may vary if special conditions are agreed upon in writing, but this applies to large orders. 11. The license is for a specific document or website. 12. The same image may be used on different pages within the same website or document. 13. An image may be used more than once, but only on the specifically named website or document detailed on the license. You cannot re-use the image on a different website, domain, sub-domain, or on another document. 14. The license will cover you only for an agreed one-time use. If you want to use the same image for a different use later on, there will be an additional fee to pay. If you want to use an image for a variety of uses at the same time then an all-in-one fee can be negotiated. 15. The license is limited by use and by time. The duration of the license is one year. 16. Images and licenses may be purchased through PayPal. 17. Clients who wish to pick and choose images to update their website as often as they like can purchase a CD with all the images on the website with a non-exclusive “blanket” license agreement.
